Legal Agreement & Acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you (the "Customer") and Sean Langwith, carrying on business as KITTY CAT HABITAT (hereinafter "we", "us", or "our"), a sole proprietorship registered in British Columbia, Canada.
These Terms form part of the contract for purchases made through our site (kittycathabitat.com). They become binding when you place an order. They also govern use of this website: the license in the Intellectual Property Rights section and the section headed Use of Our Name, Brand and Content apply to anyone who accesses or uses this website, whether or not they place an order.
Before you place an order, our Refund Policy, Privacy Policy, Shipping Policy and these Terms are presented to you as links in the footer of the checkout page and in the footer of every page of our site. By placing an order you confirm that these documents were made available to you before you paid, and that you accept them. If you do not agree to them, do not place an order.
Some of our orders are sold through Shopify Managed Markets, where Global-e US Inc. is the merchant of record and the seller rather than us. This applies to orders shipped to Austria, Belgium, Denmark, Finland, France, Germany and Portugal. For those orders, Global-e's terms of sale apply alongside these Terms and are presented to you at checkout before you pay. Every other destination is sold directly by us.
Our Refund Policy governs returns, cancellations, withdrawals, refunds, defect claims and our craftsmanship coverage. Where anything in these Terms conflicts with that policy, the Refund Policy applies.
Nothing in these Terms limits any right you have under the mandatory consumer protection law of the country where you live.
Eligibility to Purchase
By placing an order, you represent that you are the age of majority in your province/state of residence and have the legal capacity to enter into a binding contract.
Other Policies Incorporated
These Terms incorporate by reference our Refund Policy, Shipping Policy, Care & Maintenance page, and our Privacy Policy (as posted from time to time). Each forms part of the contract for purchases made through our site.
Informational Content
Product descriptions, FAQs, blog posts, social media, and other informational content are provided for general guidance only and do not create warranties, representations, or conditions beyond those expressly stated in these Terms and the incorporated policies. If there is any inconsistency, these Terms and the incorporated policies control.
Programs & Business Sales
Our Wholesale and Discount Program offerings are governed by their own terms as posted on those pages and/or by any separate written agreement we provide. We may modify, suspend, or end these programs at any time, with reasonable notice where required by law. We may also withdraw a discount code at any time at our discretion. These changes do not affect orders already placed.
Wholesale orders are governed by a separate written wholesale agreement we provide. If there is a conflict between that agreement and these Terms, the written wholesale agreement controls. Wholesale orders are not consumer purchases under these Terms unless we expressly state otherwise in writing. Participation in a Discount Program constitutes acceptance of the terms posted on that page, which are incorporated by reference for participants.
Intellectual Property Rights
The photographs, text, artwork and product designs we create or own, including the cat-head design in our logo, belong to Sean Langwith, carrying on business as Kitty Cat Habitat. They are protected by copyright law and by the law of trademarks and passing off in Canada and in other countries where those laws apply, to the extent those laws protect them. Reviews, ratings and photographs submitted by customers belong to the people who submitted them. Third-party material we use under license, such as typefaces and elements of our website platform, remains the property of its owners.
These rights apply wherever we publish that content under the Kitty Cat Habitat name, including on social media platforms, marketplaces and other third-party services, in emails and other messages we send, and in printed material such as packaging, labels, tags and cards. Publishing content in any of those places does not give anyone permission to copy, republish or reuse it, except as these Terms or the law allow. The typeface used in the lettering of our logo belongs to its owner and is licensed to Sean Langwith. The cat-ear form on the letter C in our logo was drawn by Sean Langwith and is part of our logo artwork.
License: We grant you a limited, non-exclusive license to access and use our site for personal use. This does not include any resale or commercial use of our site or its contents; any collection and use of any product listings, descriptions, or prices; or any derivative use of our site or its contents. Unauthorized commercial use is strictly prohibited. For clarity, this license permits an individual to share our content for personal, non-commercial purposes, including in honest reviews, in posts on personal social media and with photographs of products you have bought from us, provided it is not used for resale, advertising, or other commercial purposes. It does not permit any directory, listing site, advertiser or lead-generation service to use our name, logo or content, except as described under What this section does not restrict in the section headed Use of Our Name, Brand and Content.
Use of Our Name, Brand and Content
This section is part of these Terms and applies to anyone who accesses or uses this website, whether or not they place an order. Our rights in our name, marks and content do not depend on anyone accepting these Terms. They arise under the law of copyright and the law of trademarks and passing off, and false or misleading representations about our business may also breach section 52 of the Competition Act (Canada) where it applies.
Our name and marks: Kitty Cat Habitat™, Tailored For Tails™ (in any capitalization) and our logo, as a whole, including its cat-head design and the arrangement of its lettering, are unregistered trademarks of Sean Langwith, carrying on business as Kitty Cat Habitat, Nanaimo, British Columbia, Canada. The cat-head design in our logo is our original artwork. Except as allowed by the personal-use license in the Intellectual Property Rights section, under What this section does not restrict, or by our express written authorization, no one may use our logo, or any name, logo or design so similar to ours that it is likely to cause confusion with our business or products. In this section, "Our Brand" means our business name, trademarks, logo, product names, the photographs, text, artwork and product designs we create or own, and our business information, including our address, email address, telephone number and social media content.
Without our prior express written authorization, you may not:
• copy, republish, redistribute or adapt Our Brand on any website, social media account, marketplace, app or printed material, except as allowed by the personal-use license in the Intellectual Property Rights section;
• list, index or publish Our Brand in any business directory, listing site, marketplace or comparison service;
• use Our Brand in any advertising, sponsored placement, search advertising keyword, promotional email or other marketing;
• use Our Brand for lead generation, or to sell or offer "featured", "premium", "claimed" or similar placement to us or to anyone else;
• copy, scrape, crawl, harvest or extract Our Brand or any content on this website by automated means, including bots, scrapers and data-mining tools, or use it to train, fine-tune or evaluate artificial intelligence or machine-learning systems. This does not apply to search engines indexing this website for display in general search results. To the extent the law allows, we expressly reserve all text and data mining of this website and its content, including under Article 4(3) of Directive (EU) 2019/790;
• operate, display or promote any form, chat, inbox, telephone number or other channel that invites people to contact Kitty Cat Habitat but delivers their messages to anyone other than us;
• publish false or misleading information about us, including our business hours, address, telephone number, email address, website, ownership or the products we sell; or
• state or imply that you are Kitty Cat Habitat, that you are affiliated with, endorsed by, sponsored by or acting for us, or that you can receive messages, orders or payments on our behalf.
Express written authorization: Except as allowed by the personal-use license in the Intellectual Property Rights section, under What this section does not restrict or under Reviews, and except for the service providers, the withdrawal and cancellation function and the marketplace shops listed under No authorized listings, any use of Our Brand, and any publication of our details or receipt of messages on our behalf, requires our prior express written authorization. An authorization is valid only if it is signed by Sean Langwith or sent from hello@kittycathabitat.ca. It covers only the person and use it names, for any period it names, and does not extend to any other person. We may withdraw it at any time, subject to the terms of any written agreement we have made with that person. Without such an authorization, no use is authorized.
Removal on request: If you have used Our Brand in any of the ways prohibited above, you must remove it, together with all copies and images derived from it that are within your control, within 10 days of our written request, and confirm the removal to us in writing. This does not apply to any review, rating or comment described under Reviews, or to any use described under What this section does not restrict.
No authorized listings: No directory, listing site, contact service or other third party is authorized to represent Kitty Cat Habitat, to publish our details or to receive messages for us, unless we have given it our express written authorization. The only exceptions are the service providers named in our Privacy Policy, the withdrawal and cancellation function provided through your Shopify order, and our own shops on Faire (https://kittycathabitat.faire.com) and Etsy (https://www.etsy.com/shop/kittycathabitat), and any other marketplace shop linked from this website. Our official channels are this website, the postal address, email address and telephone number in the Contact Information section below, the social media accounts linked from this website, and our own shops on Faire (https://kittycathabitat.faire.com) and Etsy (https://www.etsy.com/shop/kittycathabitat), and any other marketplace shop linked from this website. Any other page that invites you to contact or message Kitty Cat Habitat, and is not one of those channels or services, is not operated by us, and we may never receive what you send through it.
Reservation of rights: We reserve all rights we hold in Our Brand, in every country where the law gives them to us, including rights under the law of copyright, trademarks and passing off, unfair competition and false or misleading representations, and, where it applies, the law protecting personal data. Nothing in these Terms grants any license to use Our Brand except the limited personal-use license in the Intellectual Property Rights section, the uses described under What this section does not restrict, and any express written authorization we give. There is no implied license or waiver: our silence, inaction, past tolerance of any use, or failure to object is not permission and does not waive any of our rights.
What this section does not restrict: This section does not prevent anyone from accurately naming Kitty Cat Habitat to refer to us or our products, for example in news reporting, commentary, a genuine review or a personal recommendation. It also does not prevent an authorized retailer, or any reseller of genuine Kitty Cat Habitat products, from using our name, product names and logo, and any product images and descriptions we have supplied to it, to identify, display, advertise and sell those genuine products. In each case the use must not state or imply that the person is Kitty Cat Habitat, or that we are affiliated with, endorse or sponsor that person beyond the fact that it sells our products.
Reviews: Nothing in these Terms restricts, or requires the removal of, any review, rating or comment by an individual about their experience of us, our products or our service, in any place, including any review site, marketplace or social media, unless the content is unlawful or clearly false or misleading.
Prohibited Uses
You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights; (e) to harass, abuse, threaten, harm, unlawfully defame, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information.
We reserve the right to terminate your use of the Service for violating any of the prohibited uses. Nothing in this section is intended to prevent you from leaving honest, lawful reviews or feedback about our products or services.
Returns, Cancellations & Defects
Our Refund Policy governs all returns, cancellations, withdrawals, refunds, defect claims, remedies and craftsmanship coverage. It is incorporated into these Terms by reference and forms part of the contract for purchases made through our site. Where anything in these Terms conflicts with it, the Refund Policy applies.
In summary, and without limiting that policy:
• You may return any item within 30 days of delivery, for any reason, wherever you are. You pay return postage. We do not accept exchanges. Our handmade products are made in small batches, so no two pieces are exactly alike. Please read the product page carefully before you buy and contact us with any questions first.
• We give a two year commercial guarantee against verified craftsmanship defects from the date of delivery, on every product we sell. It is offered in addition to your statutory rights and does not replace them. The full guarantee statement, including who gives it, what it covers, how long it lasts, where it applies and how to claim, is in the Refund Policy.
• Consumers in the European Union, Iceland, Norway and the United Kingdom have a statutory right to withdraw or cancel within 14 days, which applies whatever these Terms or that policy say, and is set out in full in the policy.
• Nothing in these Terms or in that policy limits any right you have under the mandatory consumer protection law of the country where you live.

Order Acceptance & Errors
We reserve the right to refuse, cancel, or limit any order for any reasonable reason, including suspected fraud, stock availability, or errors in product descriptions, pricing, or shipping rates. If we cancel an order after payment, we will refund all money received for the cancelled items.
Prices, Currency & Taxes
Prices are shown in the currency selected on our site and may change at any time before an order is accepted. Applicable taxes and shipping charges are calculated and shown separately at checkout before you pay, and are itemised on your order confirmation email.
Shipping, Risk of Loss, & International Import
Risk of Loss: Risk of loss and damage passes to you when you, or a person you have named to receive the goods, take physical possession of them. If a shipment is lost or damaged in transit, contact us and we will put it right. Our Shipping Policy sets out how we handle this.
Importer of Record: For orders we sell directly and ship outside Canada, you are the Importer of Record and are responsible for complying with all laws and regulations of the destination country. You are responsible for all import duties, taxes, brokerage fees, and customs charges imposed by your country. We cannot determine these amounts in advance. Where these are collected at checkout, they are shown separately before you pay. Our Shipping Policy sets out which destinations have duties and taxes collected at checkout and which have them payable on delivery.
Undelivered and Refused Packages: If a package cannot be delivered and is returned to us, contact us and we will work out the best resolution. Where you have a statutory right to cancel or withdraw from your order, refusing or not collecting a delivery does not remove that right, and our Refund Policy applies.
Force Majeure
We are not liable for delays or failure to perform caused by events beyond our reasonable control, including carrier disruptions, customs delays, natural disasters, supply interruptions, or governmental actions. This does not affect any rights you have under applicable consumer protection laws.
Product Safety & Care
Pet Toy Warning: WARNING: To prevent serious injury, use only under adult supervision. This is a play toy, not a chew toy. Ingestion of this product (wool fibres or cloth) can lead to serious gastrointestinal blockage. Inspect toys regularly. Discard and replace if torn, damaged, or parts become separated.
Supervision and Care: Animal behaviour is unpredictable. Supervise play, inspect products regularly for wear, and follow our care instructions. If a failure to supervise play, inspect products or follow care instructions contributes to damage or injury, any compensation we owe may be reduced to reflect your share of responsibility under the law on shared fault.
Warranties
Our products come with the warranties and remedies required by law, together with the voluntary craftsmanship coverage set out in our Refund Policy. We do not make additional express warranties beyond what is stated in these Terms and our incorporated policies.
Nothing in these Terms excludes or limits any implied condition, warranty or statutory guarantee that cannot lawfully be excluded, including under the Sale of Goods Act (British Columbia), the Australian Consumer Law, the Consumer Guarantees Act 1993 (New Zealand), the Consumer Rights Act 2015 (United Kingdom), the guarantee against hidden defects under Articles 1641 to 1649 of the French Code civil, the Swiss Code of Obligations, or Directive (EU) 2019/771.
We may interrupt our website temporarily for maintenance or for technical reasons beyond our control.
Limitation of Liability
Where loss is caused by ordinary negligence on our part or on the part of anyone acting for us, we are liable only for loss that was foreseeable and typical for a purchase of this kind when you placed your order. This limit does not apply to loss caused by intentional misconduct or gross negligence by us or anyone acting for us, to death or injury to body or health, or to liability under product liability laws.
Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law, including liability for personal injury or death caused by our negligence, or your statutory rights as a consumer.
Governing Law & Dispute Resolution
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of British Columbia, Canada. If you are a consumer, you also keep the protection of the mandatory provisions of the law of the country where you live. In the event of any dispute, we encourage you to contact us first at hello@kittycathabitat.ca to seek a resolution.
If you are a consumer, you may bring a claim against us in the courts of the country where you live or in the courts located in Nanaimo, British Columbia, and we may bring a claim against you only in the courts of the country where you live. If you live in British Columbia, either of us may instead bring a claim that is within the Civil Resolution Tribunal's jurisdiction before that tribunal.
If you are not a consumer, you and we submit to the jurisdiction of the courts located in Nanaimo, British Columbia.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded.
Entire Agreement
These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and KITTY CAT HABITAT regarding purchases through this site and use of this website and supersede any prior or contemporaneous communications, representations, or agreements, whether oral or written.
Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing to be effective.
Changes to Terms of Service
You can review the most current version of the Terms of Service at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes. Changes apply only to orders placed after the updated Terms are posted.
